Terms of service

These terms govern your use of foodyos.com (this site) and app.foodyos.com (the SaaS platform). By accessing or using either, you agree to these terms.

1. Who can sign up

The platform is for restaurants and food-service businesses. The signer must have legal authority to bind the restaurant. Users under 18 cannot sign.

2. What we provide

FoodyOS is an operating system for restaurants: AI ordering on WhatsApp, real-time kitchen display, cashier, floor, hostess, inventory, loyalty, analytics and delivery. Each module is enabled per tenant and billed according to the plan you contract.

3. Accounts and access

• Each restaurant has an isolated tenant. Your team logs in with users and roles (owner, manager, server, kitchen, cashier, hostess).
• You are responsible for keeping your team’s credentials confidential.
• We may suspend accounts that violate these terms or applicable law.

4. Payments and billing

Plans bill monthly. We don’t charge per-order commissions. Cancellation is by current month — no long-term contracts. State and local taxes apply where required.

5. SMS and email messaging

FoodyOS-powered restaurants may send you SMS or email messages after you provide explicit consent. By opting in to a restaurant’s SMS program through their storefront or order flow, you agree to the following:

• You are 18 years of age or older and a US resident.
• You agree to receive recurring transactional and/or marketing SMS messages from the restaurant. Up to 4 marketing messages per week per restaurant program; transactional messages as orders are placed and updated.
• Reply STOP at any time to immediately stop further messages from that restaurant. Reply HELP for support.
• Message and data rates may apply, depending on your mobile carrier and plan. FoodyOS, the restaurant, and the carriers are not liable for delayed or undelivered messages.
• Consent to receive SMS is not a condition of any purchase. You may continue to order from the restaurant without subscribing to SMS.
• SMS programs are operated through Twilio Inc. as our messaging subprocessor. Email programs are operated through SendGrid (a Twilio company). See our privacy policy for the full SMS data-handling terms.

Email programs include a one-click unsubscribe link plus a functioning postal address per CAN-SPAM. Transactional emails are sent as part of the service and not subject to the marketing opt-out.

6. Acceptable use

You may not:

• Use the platform to send spam, illegal content, or material that infringes third-party rights.
• Attempt to extract data from other tenants, break tenant isolation, or bypass authentication.
• Resell access to the platform without a written agreement with us.

7. Intellectual property

The FoodyOS software, code, design and brand are ours. You own the data you upload (menus, customers, messages). You grant us a limited license to operate the platform using that data.

8. Warranty and liability

We work hard to keep the platform available 24/7 but don’t guarantee 100% uptime. Our total liability for any claim is limited to the amount you paid us in the prior 12 months.

9. Changes

We may update these terms with 30 days’ advance notice by email. If you don’t agree, you may cancel without charge.

10. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflicts of law principles. Disputes are subject to the exclusive jurisdiction of state and federal courts located in Polk County, Florida.
